Terms and Conditions

Every work by KYMERA is created as an original — for a specific person, in a specific place. These Terms and Conditions set out the rules of engagement so that the entire process is transparent and trustworthy for both parties.
1. Operator and Seller
These Terms and Conditions govern the relationship between:

…and the buyer — a natural or legal person who expresses interest in acquiring an artwork (hereinafter referred to as "the buyer" or "the collector").
These Terms and Conditions are governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll., the Czech Civil Code (hereinafter "CCC"), and Act No. 634/1992 Coll. on consumer protection, where the buyer is a consumer within the meaning of Section 419 of the Czech Civil Code.
A consumer is defined as a natural person who does not act within the scope of their business activity or independent professional practice (Section 419 of the Czech Civil Code). Consumers are protected by specific provisions of Act No. 634/1992 Coll. and the relevant provisions of the Czech Civil Code.
A business is defined as a person acting within the scope of their business or professional activity — typically architects, design studios, or investors acquiring a work for commercial purposes. Statutory consumer protections do not apply to businesses.
2. Subject Matter
The subject of these Terms and Conditions is the sale of original artistic sculptures and objects created by a contracted artist cooperating with the seller, made from wood with implanted mechanism (hereinafter "the work" or "the sculpture"). Each work is:
- an original creation — it does not exist in any copy or replica
- assigned a unique identifier number and a certificate of authenticity
- documented photographically prior to dispatch
KYMERA does not produce limited editions, serial reproductions, or artist prints — all works offered are exclusively originals.
3. Pricing
Prices are not listed as standard on the website. Each work is priced individually with regard to its dimensions, materials, complexity of mechanism, and current availability. The indicative starting price is CZK 60,000.
A specific price quotation is issued upon request, following a personal or e-mail consultation. The quoted price remains valid for the period stated in the offer, and for a minimum of 14 days from the date of receipt.
The seller is a VAT payer. VAT ID: CZ01817566. All prices stated in a quotation are final and inclusive of VAT at the statutory rate, unless otherwise stated in the offer.
4. Order and Formation of Contract
Interest in a work may be expressed via:
- the contact form at kymera-art.com
- e-mail to atelier@kymera-art.com
- by telephone or in person by prior arrangement
Expressing an interest in a work does not constitute a binding order. A purchase agreement for a work is formed only when both parties have agreed upon:
- the specific work (or the brief for a commissioned work)
- the total price, including the method of delivery
- the delivery timeline
- the advance payment and payment terms
Confirmation of the agreement is sent by e-mail, and the seller will typically confirm receipt of the order within 3 working days.
5. Payment Terms and Advance Payment
Upon formation of the agreement, an advance payment of 30–50% of the total price of the work is due, generally within 7 days of the agreement being formed. The precise amount of the advance payment depends on the nature of the work and is agreed individually.
The remaining portion of the purchase price (the balance) is due prior to dispatch of the work, at the latest on the day of handover. Payment of the balance confirms the collector's readiness to receive the work.
Payment is made by bank transfer to the seller's account. Cash payment up to the statutory limit is also accepted upon personal collection.
6. Production Lead Time and Delivery
Each work is produced with full attention and care befitting its character. The standard production lead time is 4 to 12 weeks from receipt of the advance payment, depending on:
- the complexity of the mechanism and finish
- the dimensions and weight of the work
- the current order schedule at the atelier
The precise timeline is always stated in the order confirmation. The artist keeps the collector informed of production progress and any changes to the timeline without undue delay.
7. Delivery and Handover
Czech Republic: The work is delivered personally by the seller. Delivery within the Czech Republic is included in the price of the work. The seller will arrange the specific date and location of handover with the collector on an individual basis. Personal handover also allows for care and maintenance guidance to be given on-site.
International: For delivery outside the Czech Republic, the seller arranges transport via a specialist fine art or courier shipping service. International shipping costs, insurance, and any applicable customs charges are subject to individual agreement and are not included in the price of the work.
The work is packed prior to dispatch in a manner appropriate to its value and fragility. The buyer bears the risk of damage to the work from the moment of its receipt.
8. Authenticity and Certificate
Each KYMERA sculpture is accompanied by:
- A unique identification number discreetly placed on the work
- A certificate of authenticity signed on behalf of the seller, with a description of the work, the date of creation, and the piece number
- Photographic documentation capturing the final state of the work prior to dispatch
The certificate is an integral part of the delivery. Loss of the certificate does not invalidate ownership of the work, but complicates future verification of authenticity. In the event of loss, the seller may issue a duplicate certificate upon request.
9. Copyright
Upon purchase of a work, the collector acquires ownership of the physical object. All intellectual property rights in the work — including the right to reproduce, exhibit, distribute, or create derivative works — remain exclusively with the author and/or the seller pursuant to Act No. 121/2000 Coll. (the Czech Copyright Act).
The collector is entitled to:
- own and display the work in private or public spaces
- photograph the work for personal documentation
- resell the work as a physical object (these restrictions pass to any new owner)
Without the express written consent of the seller, the collector is not entitled to:
- reproduce, cast, 3D-scan, or otherwise copy the work
- publish photographs of the work for commercial purposes
- alter the work or incorporate it into other works
10. Withdrawal from Contract
Where the buyer is a consumer and the contract was concluded at a distance (without the physical presence of both parties), the buyer has the right to withdraw from the contract without stating a reason within 14 days of receiving the work (Section 1829 of the Czech Civil Code).
Withdrawal from the contract by the buyer — outside statutory rights — is subject to the following terms:
- Before production commences: the seller will return the advance payment in full within 14 days.
- After production has commenced, but before completion: the seller may offset demonstrably incurred costs. The remaining portion of the advance payment will be returned.
- After the work is completed: the advance payment is non-refundable. The parties may agree an alternative arrangement (e.g. resale of the work to a third party).
The seller reserves the right to withdraw from the contract in the event of unforeseen loss or destruction of materials, incapacity, or other force majeure circumstances. In such cases, the full advance payment will be returned.
Return of payments: Any monetary amount due shall be returned by bank transfer to the buyer's account within 14 days of the claim being acknowledged, unless the parties agree otherwise (Section 1832 of the Czech Civil Code).
11. Complaints and Warranty
The artist warrants that the work:
- corresponds to the description and documentation set out in the order
- has been executed with professional care and quality materials
- has mechanical parts that are functional at the time of handover
- exhibits no hidden defects of which the seller was or ought to have been aware
A statutory warranty period of 24 months from the date of receipt by the consumer applies (Section 2165(1) of the Czech Civil Code (Act No. 89/2012 Coll.)). For business buyers, rights relating to defects are governed by Section 2099 et seq. of the Czech Civil Code, without a statutory warranty period; any quality guarantee is subject to individual agreement. A complaint must be submitted by the collector in writing to atelier@kymera-art.com or to the seller's address, with a description of the defect and photographic documentation.
Complaints do not apply to:
- natural changes in materials (wood may move in response to humidity and temperature)
- damage caused by improper handling, modification, or failure to follow care instructions
- aesthetic variations that are a natural characteristic of a handcrafted original
A complaint is deemed received at the moment the written notification with photographic documentation is delivered to the seller's e-mail or postal address. The seller will confirm receipt of the complaint without undue delay, and no later than 5 working days. The complaint will be resolved within 30 days of being submitted (Section 19(3) of Act No. 634/1992 Coll.). If the seller fails to resolve the complaint within this period, the consumer has the right to withdraw from the contract or to request a reasonable reduction in the purchase price.
Return of payments: Any monetary amount due shall be returned by bank transfer to the buyer's account within 14 days of the claim being acknowledged, unless the parties agree otherwise (Section 1832 of the Czech Civil Code).
Care instructions are included with every work. Following them contributes to the longevity of the work and is a condition of warranty validity for complaints relating to mechanical parts.
12. Alternative Dispute Resolution
Where the buyer is a consumer and a dispute arising from the purchase agreement cannot be resolved by agreement, the consumer has the right to refer the matter to alternative dispute resolution with the Czech Trade Inspection Authority (ČOI) as the competent authority for out-of-court resolution of consumer disputes:

The seller does not object to participation in alternative dispute resolution.
13. Final Provisions
These Terms and Conditions are valid and effective from 29 May 2026. The seller reserves the right to update these Terms; the current version is always available at kymera-art.com/en/legal/terms.html. For agreements concluded prior to the date of any update, the Terms in effect at the time of conclusion apply.
